International Trade Partner | Guides Global Companies on Securing Market Access, Improving Returns and Supply Chain ESG Laws
With national import bans becoming a common approach to forced labor and general issues involved now well publicized, it would probably help companies if the next chapter of scholarship goes deeper into compliance details learned from the past almost ten years of this new supply chain period around how authorities are setting their market access requirements - like around traceability evidence courts will accept, how to contract adequately for worker voice evidence and how to appropriately calculate and distribute recruitment fee repayments. This might be a helpful focus for philanthropic funding and law schools. Thank you for materials this week from Emma Shafton, Meredith Anastasio, J.D. MSEL and Natalie Runyon. The U.S. Department of Commerce has issued new guidance urging financial institutions to enhance transaction screenings, with a focus on enforcing export restrictions related to foreign policy concerns, particularly regarding Russia and China. The Bureau of Industry and Security (BIS) is expanding its enforcement to include financial institutions, requiring them to prevent financing of transactions involving prohibited items, such as technology or services. Partner Corey L. Norton explains these changes and the impact they can have on financial institutions, as well as how those financial institutions can avoid penalties for non-compliance.
