Donately Corporation ("Company," "we," or “us”) respects your privacy and is committed to protecting it through our compliance with this policy.

This policy (“Policy”) describes the types of information we may collect from you or that you may provide when you visit our online properties (“Online Properties”) including https://donately.com (our "Website"), or https://dashboard.donately.com (our “Dashboard”), or https://pages.donately.com (our “Hosted Pages”), or https://api.donately.com (our “API”) and our practices for collecting, using, maintaining, protecting and disclosing that information.

This policy applies to information we collect:

  • On our Online Properties.
  • In e-mail, text and other electronic exchanges between you and us.
  • Through our embeddable donation form.
  • By your use of our API.

  • Us offline or through any other means, including on any other website operated by the Company or any third party (including our affiliates and subsidiaries); or
  • Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from, or on, our Online Properties.

You will not need to consent to this Privacy Policy, but do acknowledge you have read and understood it terms. If you do not agree with our policies and practices, your only choice is to refrain from using our Online Properties. By accessing or using our Online Properties, you agree to this Policy. Your continued use of our Online Properties after we make changes is deemed to be your acceptance of those changes, so please check the Policy periodically for updates.

Children Under the Age of 13

Our Online Properties are not intended for children under 13 years of age. No one under the age of 13 may provide any personal information to, or on, our Online Properties. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on our Online Properties, or on or through any of its features/functionality, make any donations through our Pages, or provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you may use.

If we learn that we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at support@donate.ly.

Information We Collect About You and How We Collect It

We collect several types of information from and about users of our Online Properties, including information:

As you navigate through and interact with our Online Properties, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and patterns, including:

  • Details of your visits to our Online Properties, including traffic data, location data, logs and other communication data, and the resources that you access and use on our Online Properties.

"Do Not Track" is a preference you can set in your browser to let websites you visit know that you do not want them collecting certain information about you. We do not currently respond to, or honor, Do Not Track signals or requests from your browser.

It helps us to improve our Online Properties and to deliver a better and more personalized service, including by enabling us to:

  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms of Use and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Donately, our customers or others. This may include exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. The following mechanisms should help to provide you with control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
  • Marketing Emails. You can opt-out of receiving marketing emails from us by adjusting the settings in your user account, or by using the unsubscribe button included with the marketing email.

We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

When you visit or log in to our website, cookies  and similar technologies may be used by our online data partners or vendors to associate these activities with other personal information they or others have about you, including by association with your email or home address. We (or service providers on our behalf) may then send communications and marketing to these email or home addresses. Accessing, Correcting, and Removing Your Information

You can review and change your personal information by logging into the Dashboard and visiting your account profile page.

You may also send us an e-mail at support@donate.ly to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of our Online Properties that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. All information you provide to us is encrypted and is stored on our secure servers behind firewalls. We limit access to our servers to ensure that your information is not viewable by any unauthorized parties. Additionally, we are PCI DSS v3.2 Compliant under the SAQ A standards.

All payment transactions are encrypted using SSL technology. We use Stripe as a payment gateway, and Stripe is fully PCI-compliant.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Dashboard, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Online Properties. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our Online Properties.

Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users' personal information, we will notify you by e-mail to the primary e-mail address specified in your account and/or through a notice in our Dashboard. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable e-mail address for you, and for periodically visiting our Website and this privacy policy to check for any changes.
