- The uploader claims this is from a Billboard ad, but it's really from copyrighted editorial content. Here's the link to 1972 original registrations and the issue of September 16 is listed. We hope (talk) 01:39, 14 July 2014 (UTC)

- This is what's seen at the eBay auction. There's no dating other than that of the seller and we can't see the back of the photo to determine if it has no copyright marks. There's not enough information here re: lack of copyright marks and dating for the PD-pre-1978 license. We hope (talk) 01:50, 14 July 2014 (UTC)
- It was modified by correcting the perspective and amplifying the contrast. The photo was unmistakably taken circa 1976 based on the year the album received press along with the appearances of the pictured group.--Ilovetopaint (talk) 02:15, 14 July 2014 (UTC)

- To be honest the program was in color, but this looks like a publicity still. Hmm. Sfan00 IMG (talk) 23:09, 14 July 2014 (UTC)
- Keep "While Wikipedia prefers content that is free anywhere in the world, it accepts content that is free in the United States even if it may be under copyright in some other countries." (emphasis mine) at Wikipedia:Non-U.S. copyrights. We allow images like this to be hosted locally, and have for years. And yes, this is a publicity still. Otherwise it would not have been printed on two-sided glossy paper for wide distribution (check the back, which We hope has already uploaded both locally and on an image hosting site). — Crisco 1492 (talk) 02:19, 15 July 2014 (UTC)
- Keep and/or upload to Commons. Unless evidence is found to the contrary, the statements provided on the description page suggest a reasonable conclusion that the United States is the country of first publication of this photo. If the program first aired in the United States, it makes sense that the publicity photos for it were first published in the United States. Thus, copyright of other countries would not enter into play per Commons and Wikipedia policies. -- Asclepias (talk) 05:01, 15 July 2014 (UTC)
- Based on the conversation here, I have removed the information re: do not copy to Commons. I felt I was not being honest by not mentioning that the show had aired in both the US and UK. We hope (talk) 21:49, 18 July 2014 (UTC)

- So, it is. Why would you think it is non-free?
- None of the elements of this screenshot belongs to the developer, even the rendering of font, unless the developer is the uploader. Rendered typefaces, under U.S. laws, do not pass the threshold of originality. The choice of contents and text is all the work of the creator of the worksheet. We should treat this like a photograph or diagram: If the uploader says he created this, we should accept it from him.

- Hi. So it is. But it is almost entirely text and the non-text portion does not really pass the threshold of originality. Several deletion discussions of this kind on Commons have recently ended with Kept. (They end discussions with "kept" instead of "keep". They love past tense.) - Image is CC-BY-SA but Commons has concerns with the sponsor logo for this image. Sfan00 IMG (talk) 23:25, 14 July 2014 (UTC)
- Keep. Image illustrates the vehicle, and is the same as thousands of photos both here on the site and taken generally by both media and regular people. The claim that the sponsor logo somehow makes the image non-free is utterly preposterous If it was just a close-up of the hood showing just the logo, then there might be a concern, but it is not. The Spam logo is not the subject of the image; a Spam can is not the subject of the image. The subject of the image is the #91 LJ Racing Chevrolet. - The Bushranger One ping only 20:35, 15 July 2014 (UTC)
- Keep, as a text-only logo the spam logo is too simple for copyright so we don't even need to consider whether it is de minimis. If c:Commons:Deletion requests/Files in Category:Spam (food) is the cause of the concern, the images involved there were of the entire product packaging which featured photos of the product, not just the logo. - ABC-TV in the US issued the photo to promote the show, which aired for only 10 weeks. A search of photos turns up no other copies of this, not even with tineye. Based on the conversation here, I felt I wasn't being honest not to talk about the show airing in the US and the UK. Have removed the do not copy information from the file. - Hi, can you expose briefly the reasoning leading to your conclusion that photographs of this sculptural work can be freely published in the United States? -- Asclepias (talk) 04:43, 15 July 2014 (UTC)
- The work is a work-made-for-hire and thus the Canadian government is considered the author. The Canadian government considers all copyright to have expired. There is no registered copyright. The works was originally created and published before January 1, 1978 and there is no demonstrated attempt to renew.--Labattblueboy (talk) 05:49, 15 July 2014 (UTC)
- That rationale was not accepted on Commons. A user tried to build a far-fetched argument along those lines to claim that the artist did not have rights, and to conclude that the copyright in France had expired. But it didn't work. DR on Commons. Besides, the Canadian government credits the artist. [3] If the copyright of the monument has expired in some countries, including Canada, and photos of the monument can be published freely in those countries, it is because the copyright terms in those countries are shorter than the copyright in the United States. But the policy of Wikipedia is based on the copyright in the United States. The work of the artist was still under copyright in the country of origin in 1996. Thus, the copyright on the sculptural work would be restored in the United States. Registration and renewal is not an issue in such cases. This leaves possibly a line of argumentation to determine if a large monument is a work of architecture or a work of sculpture. It looks more like a group of sculptures than like a building to shelter people. -- Asclepias (talk) 19:07, 17 July 2014 (UTC)

- Convert to fair use or delete. Derivative of a sculpture. Not free in the United States. It was not free in the source country in 1996. The artist died in 1955. A user has recently inserted a claim that this sculpture is a building [4], but this sculpture is not a "structure designed for human occupancy" [5] and thus it does not seem to meet the requirement to be subject to the exception for FoP. This conclusion applies also to the other sculptures present on the same site. The images of the sculptures, or some of those images, might be acceptable with a fair use rationale for each pictured sculpture, if the sculpture in question is the object of a commentary considered to be substantial enough in the article. If that is not possible, the image should be deleted. The substance of each commentary and how many fair use images could be in the article are matters for subjective evaluation. There is also the matter of how many fair use images of the same monument can be hosted on Wikipedia in different articles, for example File:Vimy Memorial (September 2010) cropped.jpg and File:Vimy memorial from the north side of the face.jpg. -- Asclepias (talk) 19:54, 20 July 2014 (UTC)
- There is no claim here or elsewhere that this is a structure under US copyright. The subject piece is work-made-for-hire of the government of Canada, not a commission and thus freely published in the United States because the Canadian terns have expired. Images of the memorial have been published worldwide, including in the United States since 1936, without issue because it is considered a work of the government of Canada. Whether Canada recognizes Walter Allward as the designer is irrelevant as he was an employee of the project. To my knowledge only in France is there a possibility (still debated) as to whether copyright in France applies and that itself seems debatable as it has never been exercised even thought this is one of the most prominent war memorials in France.--Labattblueboy (talk) 01:34, 23 July 2014 (UTC)
- Arguments trying to invoke Canadian copyright were also rejected on Commons. The sculpture is located in France, it was under copyright there in 1996, and the copyright was restored in the United States by the URAA. Canadian copyright does not enter into the equation about this work for Wikipedia. -- Asclepias (talk) 19:58, 23 July 2014 (UTC)

- "That rationale was not accepted on Commons." That's not true at all. The images were deleted on Commons on the basis of FOP, and there was never a decision made on the other arguments. Please actually take a look at the discussion you cited, and please don't misrepresent what happened on the other project. Also, please explain how the argument made at Commons is "far fetched", referring to the statute, articles and case law referenced in that discussion. Would love your input. Thanks.
